Handling SI employer disputes
The SIRP deals with issues of financial strength and the ability of an employer to become self-insuring

Appeals

If the applicant is denied the privilege of self-isurance and disagrees with that decision, the applicant can submit an appeal within 14 days to the Self-Insured Review Panel (SIRP). All unresolved issues involving the financial strength or the administrative ability of the employer to operate as a self-insuring employer will be referred to SIRP for a hearing.

Understanding the SIRP

The SIRP operates under Chapters 4121 and 4123 of the Ohio Revised Code (ORC). The SIRP administrator may authorize the review panel to consider the following matters:

  • Granting or denying an application for the privilege to pay compensation, etc., directly.
  • Non-renewals of SI status;.
  • Revocation of SI status.
  • Issues of an SI employer's adequacy of contribution to the SI employers' guaranty fund or need for additional security under ORC 4123.351.
  • Any other SI employer matter as authorized and delegated by the administrator under ORC Chapters 4121. and 4123.

The SIRP administrator appoints three members to the panel. The members consist of persons with expertise or experience in matters relating to self-insuring employers.

The panel holds meetings and hearings to determine matters referred to it by the administrator or our self-insured department. The panel may issue decisions without a formal hearing, and may advise the administrator or self-insured department on issues referred to it.

The panel can give an employer the opportunity for a formal hearing upon request in writing.

If an employer requests a hearing before the review panel or the panel determines a hearing is in the best interests of the employer or the State Insurance Fund, the panel will mail a notice of hearing to the employer and its representatives, setting forth the date, time and place of the hearing.
